Eric Schwartz and Rebecca Benyamin authored the article, "Copyright Termination Opinion Departs From Long-Held Views," published in Law360 on September 16, 2024. The article discusses Vetter v. Resnik, in which for the first time, a federal court has held that termination rights under Section 304 of the Copyright Act of 1976 re-capture not only U.S. copyrights but also foreign rights as well, where the original grant of rights was for “worldwide” rights.

From the article...

"...If this result were upheld, it could result in a major upheaval not just for older works and grants of rights, but for newer works and grants as well, undoing hundreds of thousands of grants and regrants of rights that were for the "worldwide" exploitation of copyrighted works."
