E-Verify

MSK Client Alert
June 2008

The Federal government has instituted a procedure called E-Verify whereby employers may elect to verify online a job applicant’s ability to lawfully work in the USA. President Bush signed an executive order on June 6, 2008, making this mandatory for federal government agencies and their contractors. This policy is quite broad and will affect all of a company’s workforce, whether or not they are involved in providing goods or services in relation to a government contract. The President delegated authority to make regulations to the Department of Homeland Security, which has indicated that it is in the process of drafting detailed regulations that should be implemented shortly.
