"The California Supreme Court is considering whether Proposition 22, a law voters approved in 2020 that enshrined independent contractor status for app-based gig workers, violates the state constitution... Gary McLaughlin, a Mitchell Silberberg & Knupp LLP who represents California employers, told Law360 it's hard to predict how the state Supreme Court will rule.
'Conventional wisdom is that if you have an employment case before the California Supreme Court, more likely than not, it's probably going to favor the employee,' he said. 'I think it's a fairly tough order to get a proposition passed by the electorate to get overturned.'"
