MSK Partner Mark Humphrey was quoted in the article, "California Cases To Watch In 2024," published by Law360 on January 1, 2024, discussing AI-related IP litigation. 

From the article... 

"Humphrey observed that early rulings against the creators show the difficulty plaintiffs will likely have in 2024 proving infringement based on the theory that an AI tool's output rips off copyright-protected published material.

However, Humphrey said he expects that as the cases proceed past the pleading stage, courtroom arguments will likely focus on the content that AI tools rely on to train their large language models, or LLMs, potentially opening the door for discovery into AI models, which up until now he said have largely been a 'black box.'"
