"One of the biggest policy questions is whether current copyright and trademark law provides a framework for development of new technologies like AI, according to Mitchell Silberberg & Knupp LLP partner Eleanor Lackman. Another question that needs to be addressed is whether AI-created works can violate intellectual property rights even if they aren't eligible for patent or copyright protection, or whether someone else in the process is responsible, she said.
'If AI can't create works, can it be the one who infringes, or is the creator, operator, or user at fault, and if so, how? There are questions like that that I think are going to have to be looked at a bit more seriously and in more context,' Lackman said."
