Quoted in the APril 13, 2012 issue of Variety, IP litigator Russ Frackman observed that the appellate court cited the common law doctrine of "willful blindness" in suggesting that user-generated content sites may no longer take comfort in the "concept of plausible deniability, where you set up a system so you can plausibly deny knowledge," effectively burying your head in the sand.
