Christine Lepera Identifies Top Media & Entertainment Cases to Watch in 2012

In an interview with Law360, MSK/NY Partner and Chair of the ABA Forum on the Sports & Entertainment Industries, Christine Lepera, discussed key cases to watch in 2012.  Included were Viacom v. YouTube in which the Second Circuit will decide to what extent the DMCA is protective of media content or is a shield for Internet service providers; Hart v. Electronic Arts (Third Circuit) and other rights of privacy cases in which First Amendment rights to create works are being weighed against a person's right to protect one's name or likeness from being commercially exploited without authorization; and Scorpio Music v. Victor Willis (Ninth Circuit) and other termination of copyrights cases challenging the ownership of countless recordings in record company catalogs, changing the dynamics in an already difficult marketplace.
