2005 Recap of Important Legislative and Case Law Developments

As we welcome the new year, this edition of the MSK Labor and Employment Department Alert looks back at some of 2005’s most important employment law developments. A number of the decisions discussed below expand the avenues for employees seeking to assert claims, particularly in the areas of harassment and retaliation, creating significant new risks for employers. A few of these developments require immediate attention, such as new postings and sexual harassment training. Finally, wage and hour issues, such as classification of employees, hours of work and meal and rest periods, remain under intense scrutiny and employers are encouraged to carefully monitor their practices to ensure compliance in this complex area.
