Civil litigation in federal and state courts throughout the United States with an emphasis on trademark, environmental and consumer law, eminent domain, distributor termination, and commercial business matters. Considerable experience in handling Attorney General Investigations and charges arising from consumer complaints.

 

Representative Matters

  • Created the official rules and operational procedures for dozens of sweepstakes and contests, including interactive online contests, for many different clients.
  • Created a complete set of documents to be utilized by dealers of high-end products ultimately marketed through in-home presentations by commissioned salespeople and financed by third parties, to ensure compliance with a myriad of federal, state, and municipal laws and regulations applicable to such businesses and sales, and also to ensure that documentary evidence exists to demonstrate compliance with such laws and regulations.
  • Assisted elderly homeowners in obtaining substantial compensation from a neighbor and tree service responsible for unlawfully cutting down and destroying six mature and treasured eucalyptus trees, the trunks of which were located partially or entirely on the clients’ property.
  • Assisted in the representation of major burglar alarm associations in successful challenges to efforts by municipal law enforcement officials to eliminate police responses to reports of burglar alarm activations.
  • Represented a major manufacturer of household appliances in litigation throughout the United States arising out of termination of distributorships, as well as trademark infringement and unfair competition actions.
  • Defended national financial institution before the California Court of Appeal against allegations of false advertising under the Lanham Act.
